Nepali reporter Surendra Phuyal lost his injunction case against Filipina Chin
Cabrido after Kathmandu Court gave a verdict that favored Cabrido. The
injunction is a protection order requested by Phuyal from Kathmandu Court to
stop Cabrido from defaming him through social media, phone calls, text
messages, publication of stories in news, blackmails and issuing public
statement regarding the ongoing cases. However, Phuyal was not able to provide
proofs of actual defamation, harassments, threats and blackmails from Chin
Cabrido that led to the dismissal of his injunction petition.
Chin
Cabrido met Surendra Phuyal and they became a married couple and have been
living together since June 2010 in Khursanitar, Lazimpat. Chin was pregnant
with him in November 2011 when she found out that Surendra lied to her and that
he was already married in 2008 with another Nepali girl. Phuyal refused to take responsibility of
their baby and asked Chin to abort it. Chin lost her baby due to emotional and
psychological abuses from Phuyal. In 2012, Chin Cabrido has filed for divorce,
domestic violence, sexual abuse and contempt of court against Surendra Phuyal.
These
court cases came out in media and were printed in newspapers. Surendra Phuyal
asked the Kathmandu District Court to issue an injunction or protection order
against Cabrido to stop discussing these ongoing cases in media claiming that the
media news is hampering his career and family life. However, the court has
denied the request of Phuyal by dismissing his injunction request due to lack
of evidence.
In
April 2012, Chin Cabrido won an interim protection order from Kathmandu
District Court after complaining of multiple threats from Phuyal and his family
after she filed cases on divorce, domestic violence, sexual abuse and contempt
of court in Nepal. Chin Cabrido’s protection order is still valid and upheld
due to strong evidences while Surendra Phuyal’s injunction petition was denied.

The recent court decision was favorably celebrated by women human
rights activists in Nepal such Dr. Renu Bhadari, Chairperson at National
Alliance of Women Human Rights Defenders (NAWHRD). Dr. Bhandari said, “ We
shall overcome one day all abuses and violence. ” Radha Paudel, Founder,
President at Action Works Nepal posted a message to Chin Cabrido saying, “You
are brave, you are source of inspiration for all of us and will be for ever:)
